Brazil is the largest country in South America while also being the most populated one with more than 207 million people.
Almost all gambling activities have been prohibited in Brazil for over 70 years. Since the general ban on crazy time live of chance in 1941, the only legal gambling activities are the lotteries under the state monopoly, and horse-race wagering. According to Brazilian law, poker is a game of skill and is therefore not illegal.
The current legislation partially forbids gambling activities in Brazil. The practice of gambling is currently mainly dealt with by the Law of Misdemeanors. It was drafted with the intention to preserve social morality, in line with the accepted societal values of 1941. It forbids the practice of gambling, referred to as "crazy time live of chance" in the legislation. That is, those who establish or exploit crazy time live of chance in a public place or place accessible to the public, by means of the payment of an entry fee or otherwise, commit a misdemeanor. Gambling is punishable by imprisonment of three months to one year and a fine.
Since the statute that governs crazy time live of chance was enacted in the early 1940s and has not been modified since then, there is no differentiation between land-based and online gambling. The existing statute is interpreted as encompassing both. The law forbids the establishment of the means or provision of access to crazy time live of chance. This should be construed as any kind of means, including in the virtual world.
Shifting regulations
With the economic turmoil, it has been said that gambling regulation (and taxation) may help the government to raise revenues. Two bills of law are currently under discussion in the Congress concerning casinos, bingos, online gaming and lotteries. Integrated resort casinos were included in the Tourism Law Bill and there may be an Integrated Resort bill introduced later this year.
On 12 December 2018, the Brazilian Congress approved a new law, which established a new model of lottery, known as fixed-odds sports betting. In order to qualify as fixed-odds sports betting, the bettor must know his or her reward at the time of the bet.
Fixed-odds sport betting has been set up as a public service, which means that the Ministry of Finance can grant concessions or authorizations in the form of a license to interested parties to explore this activity. These licenses are not exclusive, and so multiple players are expected to compete in this market. Brick-and-mortar and online channels may both be exploited by licensees.
Right now Brazil is in the process of changing the history of its gambling industry. Considering some estimations, the total illegal gambling has accumulated US$6.4 billion in Gross Gaming Revenue, while the offshore online gray market is worth US$2.1 billion annually in GGR. What’s more, it is calculated that, before the current worldwide health crisis, around 200,000 Brazilians were traveling to foreign casinos to gamble every month. Only Las Vegas receives about 150,000 Brazilians a year.
Movements by the actual presidency
The government of President Jair Bolsonaro is finally advancing to the regulation and legalization of gambling. Bolsonaro is following the trend left by former President Michel Temer, who, in December 2018, legalized sports betting by signing provisional measure 846 into law, after its successful passage through both chambers of the Brazilian parliament. Now, in June 2020, Bolsonaro’s government approved the qualification of the sports lottery in the Investment Partnership Program (PPI). The privatization of the public lottery service called ‘fixed-odds bets’ is planned to grant concessions for operators to provide this service and collect taxes for this vertical.
Commonly known as “sports betting”, this is a lottery in which the player tries to predict the outcome of sporting real events, such as scores, number of cards, who will make the first goal, etc., at football crazy time live, but not restricted exclusively to this sport. Unlike other lotteries, in sports betting, the bettor knows, at the time of the bet, how much he/she can win in the event of a hit by means of a multiplier (the fixed odds) of the stake.
Foreign companies have taken into matters of exploring these new options through virtual means, however, all the potential revenue that comes out of it ends up leaving the country.
The country’s planning on gambling
A key issue about the mentioned Investment Partnerships Program (PPI) is that it aims to boost the tourism sector through private investments. Tourism Minister Marcelo Álvaro Antônio explained he has a proposal for authorizing casino-equipped integrated resorts. He underlined that the plan is not to promote legalization of crazy time live of chance, bingo and slots outside resorts.
Taking into account that, according to consulting firm Statista, Brazil’s tourism revenue will fall by nearly 39% this year, the proposal is of greatest relevance. In that perspective, José Calisto, president the Association of Employees in Hotels and Similar in Rio de Janeiro (AEHSRJ), commented: “It is very important to legalize casinos in Brazil, even if, at the first moment, it is in resorts, and in a second phase, expanding to the rest of the tourist points and others. Today, there are casinos and bingos spread all over Brazil in a clandestine way, and if legalized, they would generate jobs and income.” He estimates that 300,000 direct jobs (and other similar number of indirect ones) would be created in the hospitality sector if casinos (or casino resorts) were legalized.
Lately, a virtual hearing of Brazil’s Supreme Federal Court on September 30th, 2020, voted unanimously about a decision that declared that a decree passed in 1967 about granting exclusivity over the operation of lotteries to the federal government was in direct conflict with the Brazilian Constitution of 1988, effectively slowing down the ongoing processes of flexibilization of gambling regulations and clouding the future of lotteries and sports betting in the country
A bit of history about the meaning of gambling.
For a brief period in the 1990s, bingos and slot machines were permitted, but they were banned in the mid-2000s.
Due to this, Brazil's gambling regulation is still incipient. 'Game' is a contract type expressly nominated, but not defined, by the Brazilian Civil Code. Its definition is provided by jurisprudence.
Luiz da Cunha Gonçalves defines a game contract as 'a commitment, agreed as for hobby or as for desire for money, between two or more individuals, in which each player agrees to pay a certain sum of cash or something else to the other party(ies) if he/she loses, based on some future event, which implementation depends, at least in part, on the activity of the players'.
Clóvis Beviláqua, the author of the previous Brazilian Civil Code, defines a game contract as a random contract, in which two or more people promise a certain sum, among the contractors, to the person for whom the result of chance is most favorable. In the same vein, Pablo Stolze Gagliano and Rodolfo Pamplona Filho provide a very detailed explanation on game contracts.
The difference between a game and a bet is that the result of a game will depend on the action of the parties, while the result of a bet depends on facts unrelated to the parties' will. It is important to highlight that these definitions have been created by jurisprudence and are not expressly set forth by law, although they are widely accepted and applied by the courts.
